TERMS & CONDITIONS
These Terms and Conditions govern the offer and sale of Products (as defined below) created by Enjoylive Travel srl, with its registered office in Pesaro, via XI Febbraio 42, registered in the Pesaro and Urbino Companies Register under No. 02537740413, Tax Code and VAT No. 02537740413, Registration R.E.A. PS-189926.
When acting as a travel agency pursuant to applicable law, Enjoylive Travel srl is covered by insurance policy N. 15015002290/m provided by Nobis Assicurazioni.
TRAVEL CONTRACTS AND RESPONSIBILITY
Reservations are regulated by these general conditions under Law no. 111 of 17 March 1995 implementing Directive n. 91914 / EEC and in accordance with law no. 1084 of 27/12/1977. The responsibility of Enjoylive Travel can not in any case exceed the limits provided by the laws mentioned. For reasons of force majeure.
Enjoylive Travel reserves the right to change hotel with other close and / or of the same level. Enjoylive Travel is not responsible for damages caused by customers.
Bookings are on request and subject to availability. The acceptance of bookings will be sent by Enjoylive Travel by fax or e-mail.
All published prices are per person and include service fees and taxes in force at the time of publication. In case of increases of them, prices must be adjusted to changes. Prices do not include drinks, extras, tips, entrance fees and anything not expressly mentioned.
City tax is not included in prices and has to be paid directly by guests at the hotel.
The full amount must be paid for each reservation, no later than 30 days before the arrival of clients and always before sending the voucher. The payment must be made in compliance with the proforma invoices sent by Enjoylive Travel on confirmation of booking. A copy of the receipt of payment must be sent via fax or email to Enjoylive Travel. In case this deadline is not respected, Enjoylive Travel has the right to cancel booking/s even after receiving any payment. Payments are accepted by bank transfer.
TRAVEL DOCUMENTS (VOUCHER)
Travel documents will be Sent (by fax, email or mail) from Enjoylive Travel only after receiving full payment of the invoice.
In case of interruption of the stay there shall be no refund, unless the group or the traveler does not present to Enjoylive Travel a written statement from the hotel management stating that it will not apply any cost for services not used. Enjoylive Travel will reimburse only the amount authorized by the hotel, after deducting any agency fees or other expense.
WITHDRAWAL BY THE TRAVELER
Given the particular characteristics of the proposed packages, in case of withdrawal after registration, Enjoylive Travel will apply the following penalties. After the confirmation of booking, the customer must pay tickets purchased and the costs of acquisition of them. Once confirmed, the tickets are therefore not refundable. On the remaining part of the sum will be applied the following penalties:
- 10% up to 30 days before departure;
- 25% from 29 to 21 days prior to departure;
- 50% from the 20th to the 11 th working day before departure;
- 75% from the 10th to the 3rd day before departure;
- No refunds after that time.
Some services may be subject to different penalties, that will be communicated at the moment of booking. The Organiser shall not be liable if, after sending of the commercial proposal, the musical event should be changed respect to the official calendar (eg. Replacement of the director, soloist, program modification, etc.). The participant who will not accept this change, the penalty will be applied above. Furthermore, in the event of cancellation of the performance by the theater will be refunded only the face value of the ticket.
CANCELLATION OF THE TRIP BY THE ORGANISER
According to Art. 10 of Law 1084 of December 29, 1977, the Organiser may cancel the contract, in whole or in part, without any allowance in case of circumstances beyond its control (strikes, cancellations due to severe weather conditions, wars, civil and military disorders, riots, disasters, looting , acts of terrorism). These facts or other similar are force majeure and are not attributable to the carriers and to the Organiser. Any additional expenses substained by the traveller will not be reimbursed , nor will the performances that, because of such causes, were not provided and were not recovered.
Any failure of the contract must be notified by the traveler without delay so that the organizer, its local representative or guide, can promptly remedy the situation. The traveler can also make a complaint by sending a registered letter with acknowledgment of receipt, to the Organizer or to the Seller no later than ten working days from the date of return to the place of departure.
For any disputes will be competent the Court of Pesaro.
